Acceptance of Terms

By accessing or using our website, Physio Visual (hereafter referred to as “the Site”), you agree to be bound by these Terms of Service (hereinafter referred to as “the Terms”). If you do not agree to these Terms, please do not access or use the Site.
Modification of Terms

The Site reserves the right to modify these Terms at any time. By continuing to access or use the Site after such modifications, you agree to be bound by the revised Terms. The most current version of the Terms at the time of your use will apply.

■ Conditions of Use for Services

1. Limitations on Use of Downloaded Materials

You may use the materials (PDF, PowerPoint, PNG) downloaded from the Site for the following purposes, and you are allowed to freely edit and modify these materials:

Providing exercise guidance to patients or clients in medical and welfare facilities and other healthcare services.
Using in newsletters or other broadly distributed printed materials for exercise instruction and promotion.
Utilizing as presentation materials at conferences or training sessions.
Publishing on websites or blogs for the purpose of instructing or enlightening the public or specific target audiences about exercise.
Posting on social media for the purpose of exercise instruction and promotion.

2. Restrictions on Period of Use

※The use of the materials downloaded from the Site is limited to the duration of your membership registration.
※After cancellation, you may not use any materials downloaded during the membership period, including any modifications made to them..

Detailed Conditions

Provision to Target Recipients: When handing over the materials for the purpose of exercise instruction, you must be a registered member at the time of distribution. However, once materials have been distributed, target recipients can use them regardless of membership status.
Use in Publicity Materials: When the materials are included in newsletters or other pamphlets, you must be a registered member at the time these documents are distributed.
Use in Presentations: If you use the materials as presentation materials at conferences or training sessions, you must be a registered member at the time of the presentation.
Online Posting: If you post the materials on websites or blogs, you must be a registered member at the time of publication.
Social Media Posting: When using the materials for exercise instruction or promotion on social media, you must be a registered member at the time of posting.

Prohibited Uses

The materials downloaded from the site cannot be lent, transferred, redistributed, or otherwise made available to third parties for purposes other than exercise instruction or promotion, whether for profit or not.
You cannot operate a website using the materials as the primary content, offer services creating such materials, or use them in products.
Running a website that distributes the materials or setting up such a page on blogs or other websites is not permitted.

■ Penalties for Violation of Terms

Service Suspension: If a member violates these Terms, or is suspected of such, the Site may suspend all or part of the services without prior notice to the member. The Site will not be liable for any damages incurred by the member as a result of this suspension.
Penalty for Misuse: If a member violates these Terms and misuses the Site’s materials, they must pay a penalty of 500 USD per violated material. If the damages incurred by the Site exceed 500 USD, the member will also be liable for the excess amount, including reasonable attorney fees.
Compensation for Damages: If the Site incurs any damages related to violations of these Terms, including unauthorized use by a user, the user must compensate the Site for all associated costs, including reasonable attorney fees.

■ Intellectual Property Rights

All materials on the Site are available for download, editing, and modification, but their copyright remains with the Site operator, Yu Kawaishi. Copyright is not transferred or shifted regardless of the extent or presence of modification.

■ Membership Registration

Fees and Payment Methods
Members agree to pay the fees set by the Site using the payment methods specified by us.
Term and Renewal
Membership is automatically renewed until a member requests cancellation.
Cancellation
Members may cancel their membership following the procedures specified by the Site. Services are not accessible after the membership period ends, and fees paid are non-refundable, even if cancellation occurs mid-term.

■ Account Creation and Management

Members must not transfer or share their member email address and password with anyone other than the registrant.
The Site will not be held responsible for any damages arising from the use of a member’s email address and password by a third party, unless there is intentional misconduct or gross negligence on the part of the Site.

■ Disclaimer

The Site is not responsible for any damages, accidents, or disruptions caused by the use of the materials downloaded from the site. We also do not assume liability for any direct, punitive, special, indirect, incidental, or consequential damages, including lost profits, arising from the use of the Site or its materials.
The Site may suspend or discontinue service provision without prior notice to the user if deemed necessary due to maintenance, updates, force majeure events, accidents, or other circumstances where providing the service is deemed difficult.
The Site reserves the right to suspend or discontinue all or part of its services without prior notification to members under the following circumstances:

Maintenance, inspection, or updates of the computer systems involved in the services.
Difficulties in providing the services due to force majeure events such as earthquakes, lightning, fire, power outages, or other natural disasters.
Stoppage of computers or communication lines due to accidents.
Any other situation where the Site deems it difficult to provide the services.

The Site will not be liable for any disadvantages or damages suffered by members or third parties due to the suspension or discontinuation of the services.

Additionally, the Site may modify the content of the services or discontinue them entirely at any time without notifying users, and will not be liable for any damages incurred by members as a result.

The Site also reserves the right to close down and terminate the services at any time without notice, and will not be responsible for any damages incurred by users as a result.
